1. Applicable legislation

This privacy policy is adapted to the Spanish and European regulations in force on personal data protection. Specifically, it complies with:

• Regulation (EU) 2016/679 (GDPR), on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

• Spanish Organic Law 3/2018 (LOPD-GDD), on Personal Data Protection and the guarantee of digital rights.

• Spanish Law 34/2002 (LSSI-CE), on Information Society Services and Electronic Commerce.

3. Record of personal data

In compliance with the GDPR and LOPD-GDD, the personal data collected through the Website's forms will be incorporated and processed in our records in order to facilitate, expedite and fulfil the commitments between Teix and the User, maintain the relationship established, or respond to a request or enquiry. A record of processing activities is kept in accordance with the GDPR, unless the exception in Article 30.5 applies.

4. Principles applicable to processing

Processing is subject to the principles of Article 5 of the GDPR:

• Lawfulness, fairness and transparency: the User's consent is required following transparent information about the purposes.

• Purpose limitation: data is collected for specified, explicit and legitimate purposes.

• Data minimisation: only strictly necessary data is collected.

• Accuracy: data must be accurate and kept up to date.

• Storage limitation: data is kept only for as long as necessary for the purposes of processing.

• Integrity and confidentiality: security and confidentiality are guaranteed.

• Accountability: the controller is responsible for ensuring compliance with these principles.

5. Data categories and legal basis

The categories of data processed are identification data only. Special categories of data (Art. 9 GDPR) are never processed.

The legal basis for processing is the User's consent, which will be express and verifiable for one or more specific purposes. The User may withdraw consent at any time, as easily as it was given; as a general rule, withdrawal does not affect the use of the Website.

6. Purposes and retention periods

Data is collected to facilitate and fulfil the commitments between the Website and the User, maintain the relationship established, or respond to requests and enquiries, and where applicable for operational and statistical purposes and to improve the quality and navigation of the Website. At the time of collection, the User will be informed of the specific purpose of processing.

Data will be retained for the minimum time necessary and, in any case, for a maximum period of 2 years, or until the User requests its erasure.

Measurement of emails to clients: the reports and notices we send to our clients (portal report, monthly website report and SEO report) may include a tracking image and measured links that tell us whether the email has been opened, when, and whether the client portal has been accessed. We use this only to know whether the information is reaching you and to follow up on the service, on the basis of Teix's legitimate interest (Art. 6.1.f GDPR). It is not shared with third parties. You can prevent it by blocking images in your email program or ask us not to measure it by writing to hola@teixweb.com.

7. Recipients, processors and transfers

We do not sell or hand over your personal data to third parties, except where required by law. To provide our service, some providers process data on behalf of Teix as processors, under a contract in accordance with Article 28 of the GDPR:

• Hosting of this website and of our customer management system, on servers located in Spain.

• Google (Google Workspace, for email and calendar; and Google Analytics 4, only if you accept cookies).

• Anthropic (Claude artificial intelligence models): the website chat assistant, the automated analysis of the free audit and of the AI visibility test, and support for our team in handling requests and communications.

• Holded (invoicing and management, if you become a client).

Some of these providers are located in the United States. Those international transfers are covered by the EU-US Data Privacy Framework or by the standard contractual clauses approved by the European Commission.

In accordance with Article 8 of the GDPR and Article 7 of the LOPD-GDD, only those over 14 years of age may give their consent. For children under 14, the consent of parents or guardians is required.

8. Use of artificial intelligence

At Teix we use artificial intelligence and we tell you so clearly, in accordance with Regulation (EU) 2024/1689 on Artificial Intelligence:

• Chat assistant: when you write to "Teia" you are talking to an AI system, not a person. If you would rather talk to someone from the team, we will put you in touch.

• Free audit and AI visibility test: the analysis of your website is partly carried out by an AI using the public information on your page. The results are for guidance only.

• Videos: the voice-over in our videos is generated with AI, using synthetic voices. This is stated next to each video.

• Content: some of the texts on this website and blog are written with the help of AI; they are always reviewed and approved by our team, which is responsible for them.

We do not take decisions based solely on automated processing that produce legal effects concerning you or similarly significantly affect you (Art. 22 GDPR): there is a person behind every proposal and every quote. The AI provider that processes your data (Anthropic) does not use it to train its models, according to its commercial terms. 9. Use of WhatsApp (Meta's WhatsApp Business Platform)

We handle enquiries and hold conversations with interested people and with clients through WhatsApp Business, using Meta's WhatsApp Business Platform (Cloud API). Messages sent and received are recorded in Teix's internal customer management system (CRM), where the contact's record is created or updated (name, phone number, messages and, if provided, email address) in order to handle the enquiry, follow it up and arrange meetings.

Legal basis: the consent shown by writing to us on one's own initiative and Teix's legitimate interest in replying to whoever contacts us (Art. 6(1)(a) and 6(1)(f) GDPR); and, when a quote, a meeting or a proposal is requested, the implementation of pre-contractual measures at the data subject's request (Art. 6(1)(b) GDPR).

Processor: Meta Platforms Ireland Ltd. provides the infrastructure of the WhatsApp Business Platform and processes the data on behalf of Teix as a processor, under the WhatsApp Business data processing terms. Where the processing involves international transfers, they rely on the safeguards described in section 7.

We do not sell or hand over this data to third parties, nor do we use it for advertising purposes or to build profiles for that purpose.

Retention: WhatsApp data is kept for as long as the conversation or the relationship with Teix lasts and, at most, for the period stated in section 6, or until its erasure is requested, unless the law requires it to be kept for longer. If a client connects their own WhatsApp Business account to Teix's services, the stored messages are deleted within 30 days of the account being disconnected, unless the law requires them to be kept; in that case the client decides what the data is used for and Teix processes it on the client's instructions.

10. Confidentiality and security

Teix adopts the technical and organisational measures necessary, at a level of security appropriate to the risk, to ensure the security of the data and prevent its accidental or unlawful destruction, loss or alteration and unauthorised access. The Website has an SSL certificate that ensures encrypted transmission of the data. In the event of a security breach entailing a high risk to the rights and freedoms of individuals, the controller will notify the User without undue delay. The data will be treated as confidential.

11. User rights

The User may exercise the following rights recognised in the GDPR and LOPD-GDD against the controller: access, rectification, erasure ("the right to be forgotten"), restriction of processing, data portability, objection, and the right not to be subject to automated individual decision-making (including profiling).

The User may exercise these rights by written communication to the controller with the reference "GDPR-https://teixweb.com/", stating full name, a copy of an identity document, the specific request, an address for notifications, date and signature. 12. Complaints to the supervisory authority

If the User believes there is a problem or infringement in the processing of their data, they have the right to effective judicial protection and to lodge a complaint with a supervisory authority. In Spain, the supervisory authority is the Spanish Data Protection Agency (https://www.aepd.es/).

13. Acceptance and changes

Use of the Website implies acceptance of this Privacy Policy. Teix reserves the right to amend it at its own discretion or due to legislative or case-law changes. Users are advised to check this page periodically. This policy is adapted to the GDPR and the LOPD-GDD.
